If your application for merits review before the Administrative Appeals Tribunal (AAT) has not been successful, you may have a legal avenue for review of the AAT’s decision. The Federal Circuit Court (FCC) will consider whether the AAT has made a jurisdictional error (issue on the authority to decide a matter in the case) or has an error of law (law not correctly interpreted) in their decision. It is important to note that the FCC cannot reconsider the merits of your case.

Federal Court

In certain cases, an applicant may not have an opportunity to appal to the Administrative Appeals Tribunal (AAT) and will only have the right to appeal directly to the Federal Court. This happens when the Minister for Home Affairs personally makes a decision to either refuse or cancel a person’s visa in Australia under character provisions of the Migration Act. In these situations, it is of utmost importance to engage legal representation immediately, in order to have a plan and know your prospects moving forward.

Further, if your case has been successful in the Federal Circuit Court (FCC), there may be a legal avenue available to you in the Federal Court. The Federal Court will consider whether there has been an error of law or jurisdiction made by the FCC.
